MSCC, Sharon Jasprizza, Event September 1, 2026
NOTE ABOUT THIS SUMMARY: The MSCC Homeless & Housing Meeting for September was cancelled due to the intensive work required to fight for the preservation of public housing. This document serves as a summary of current work in progress based on the Legal and Strategy Committee meetings.
SUMMARY
- Legal and Strategy Committee: Following the meeting on August 31, 2026, the committee is moving forward with a formal letter to Steve Banks and a review of the Final Environmental Impact Statement (FEIS) report.
- John Low-Beer, Attorney: Currently waiting for a ruling from the Appellate Division on a motion for interim relief. He emphasized the priority of keeping tenants in Fulton 11 and Chelsea Addition in their homes and noted that if the ruling is unfavorable, the team will seek leave to appeal to the NY Court of Appeals.
- Tom Hilgardner, Attorney: Representing the coalition in a harassment filing (Index # LT-001033-26/NY) following an August 24 court appearance. He is currently seeking critical documentation to represent Fulton tenant Dupree at the Office of Impartial Hearings (OIH). https://www.nyc.gov/site/nycha/about/oih.page
- Significant FOIL requests show that the Mayor’s office has withheld a 2025 “Confirmatory Supplemental Letter of Support” which NYCHA publicly claimed to have received.
LEGAL FILINGS AND TENANT ADVOCACY
- Motion to Re-Litigate: The legal team is managing multiple filings, including Judge Cohen’s decision and opposition from NYCHA regarding interim relief.
FOIL REQUESTS AND CITY HALL TRANSPARENCY
- Exemption Challenges: Layla Law-Gisiko has filed an appeal against the Mayor’s Office for withholding responsive records under the inter-/intra-agency exemption.
- HUD Transmissions: The appeal argues that if these records were transmitted to HUD, a federal agency, the inter-agency exemption does not apply according to the New York Court of Appeals.
- Missing Supplemental Letter: The City has failed to explain the status of the second supplemental letter from 2025, which was part of the governmental approvals required for the redevelopment of Fulton and Elliott-Chelsea.
